Scope and seller

These general terms and conditions of sale apply to sales contracts concluded online via the website www.Phonecases.co.uk or www.Phonecases.co.uk between Phonecases.co.uk (us) and its consumer customers (you).

Conclusion of contract

In accordance with the provisions of the Civil Code on the conclusion of online contracts, the contract will be concluded when you click the button that allows you to confirm your order, after having reviewed the details of that order, including the total price, and having had the opportunity to correct any errors.

Language

The language proposed for the conclusion of the contract is English.

Acceptance of the terms and conditions

Before concluding a contract with us, you must read the terms and conditions and accept them by ticking the corresponding box during the order process.

Storage

Contracts concluded on our website (data relating to your order and the terms in force at the time of your order) are stored for a period of 10 years. You can access archived contracts by requesting them from [email protected].

Price

VAT is included in the prices displayed on our website at the currently applicable legal rate. All prices listed on our website are shown inclusive of all charges, in pounds sterling. Any additional costs that may be charged to you are indicated before the contract is concluded. Deliveries to countries outside the European Union may be subject to various taxes and charges, including customs duties and import VAT. These costs are borne solely by the buyer.

Delivery

Delivery is available to the United Kingdom. The delivery time is 3 to 5 days. If the delivery time for a product is longer, this information will be noted on the relevant product page.

Payment

The following payment methods are available for purchases made on our website:

Please note that goods will be dispatched once payment has been received. To receive your products as quickly as possible, we recommend paying by debit card.

Retention of title

Ownership will transfer to you once full payment has been received.

Transfer of risk

The risk of deterioration or loss of the goods transfers to you upon receipt of the delivery.

Right to cancel

You have the right to cancel this contract within thirty days, without giving any reason. The cancellation period expires thirty days after the day on which you, or a third party other than the carrier and nominated by you, takes physical possession of the last item.

To exercise the right to cancel, you must inform us of your decision to cancel this contract by means of a clear statement, by email at [email protected] or via the contact form on our website.

You may use the model cancellation form, but it is not obligatory. To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right to cancel before the cancellation period has expired.

Returns

Please send the goods back to us, or hand them over to us, at the following address: Phonecases.co.uk, Postbus 87, 3830 AG Leusden, Netherlands. Without undue delay and, in any event, within 14 days from the day on which you communicate your cancellation of this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired. You will bear the direct cost of returning the goods.

Effects of cancellation

If you cancel this contract, we will reimburse all payments received from you, including the costs of delivery (except for any additional costs arising from your choice, where applicable, of a delivery method other than the least expensive standard delivery method offered by us), without undue delay and, in any event, no later than fourteen days from the day on which we are informed of your decision to cancel this contract. We will carry out the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back, or until you have supplied evidence of having sent back the goods, whichever is the earliest.

Exceptions to the right to cancel

The right of withdrawal cannot be exercised for the following contracts:

  • contracts for the supply of goods made to the consumer's specifications or clearly personalised;
  • contracts for the supply of goods that are liable to deteriorate or expire rapidly;
  • contracts for the supply of a newspaper, periodical or magazine, with the exception of subscription contracts for such publications;
  • contracts for the supply of goods which have been opened by the consumer after delivery and which cannot be returned for reasons of hygiene or health protection;
  • contracts for the supply of goods which, after delivery, are by their nature inseparably mixed with other items;
  • contracts for the supply of audio or video recordings or computer software that have been opened by the consumer after delivery;
  • contracts for the supply of alcoholic beverages whose delivery is deferred beyond thirty days and whose value agreed at the time of conclusion of the contract depends on fluctuations in the market beyond the trader's control;
  • contracts for the supply of goods or services whose price depends on fluctuations in the financial market beyond the trader's control and liable to occur during the withdrawal period;
  • contracts for the supply of services fully performed before the end of the withdrawal period, where performance has begun with the consumer's prior express consent and express waiver of their right of withdrawal;
  • contracts for maintenance or repair work to be carried out urgently at the consumer's home and expressly requested by them, limited to the spare parts and work strictly necessary to address the emergency;
  • contracts for the provision of accommodation, transport, catering or leisure services to be provided on a specific date or at a specific frequency;
  • contracts for the supply of digital content not provided on a tangible medium, where performance has begun with the consumer's prior express consent and express waiver of their right of withdrawal.

Your legal rights

Under the Consumer Rights Act 2015, the goods we supply must be of satisfactory quality, fit for purpose and as described. If they are not, you have the right to reject them within 30 days of delivery for a full refund. After that period you are entitled to a repair or replacement and, if that is not possible or does not resolve the problem, to a price reduction or a refund. These rights are in addition to our returns policy and are not affected by it. More information is available from Citizens Advice.

Transfer of risk

The risk of deterioration or loss of goods transfers to you when you take possession of the delivered goods, or when the goods are handed to a carrier arranged by you, other than one of those offered on our site.
